The Artificial Museum Framework is an exhibition platform comprising the Artificial Museum, Artificial LAB, Artificial NET and Artificial HUB.
Provider: Refers to the SystemKunst KG, which operates the Artificial Museum Framework. The Provider is legally represented by SystemKunst KG. All rights of the Provider agreed upon in this Agreement also apply to the SystemKollektiv (a registered Verein/NGO in Vienna, Austria).
User (or Users): Refers to the artist, individual, or entity who registers an account and uses the Artificial Museum Framework services, including lending Artifacts for exhibition.
Artifacts: Refers to the digital representations of an artwork (3D models, images, audio, video, metadata, etc.) lent by the User to the Provider for exhibition and Augmented Reality (AR) applications.
This Agreement is between the Provider and the User and outlines the terms and conditions governing the use of the Artificial Museum Framework services and the lending of Artifacts by Users for exhibition and Augmented Reality (AR) applications.
This agreement applies to all Artifacts lent by Users to the Provider for exhibition, AR applications, and associated uses, especially but not exclusively in public spaces.
Age Requirement: Users must be at least 16 years of age to register an account and use the Provider's services.
Account Types: The following account types are offered: Explorer (Free), Artist, and Curator tiers. The basic, default account is the Explorer with a Free tier.
Account Rules: Users may upgrade or downgrade accounts as needed and must maintain one account per person without exceptions.
Lending of Artifacts: Users agree to lend their Artifacts to the Provider for exhibition and AR applications in public spaces.
Exhibition and AR Applications: The Provider reserves the right to exhibit the Artifacts in its collections and use them in AR applications in public spaces.
Promotional Use: The Provider may use the Artifacts, images of the Artifacts, and any associated metadata in press releases, social media, and other promotional materials.
Legal Compliance: Users ensure that Artifacts and their digital representations comply with Austrian and European Union laws, including intellectual property and content regulations.
Copyright Retention and License Grant: Users retain their copyright and intellectual property rights over their Artifacts. By lending Artifacts, the User grants the Provider a non-exclusive, royalty-free license to use the Artifacts, images, and metadata for exhibition, AR, and promotional purposes.
Ownership Warranty: Users confirm they own all intellectual property rights to uploaded content or have secured written permission from rights holders prior to upload.
Marketing Rights: the Provider reserves the right to use Artifacts and content for marketing, branding, and communication across all media.
Fair Use: The Provider's use may be considered fair use under copyright law, provided it does not infringe on the Users' rights.
Personally Identifiable Information (PII): The Provider generally does not save PII unless required for service functionality (e.g., email addresses) or deliberately published by the User (e.g., names, homepages in credits). By adding information to the credits, the uploader guarantees they have the right to publish any PII included.
Confidentiality: Users agree to protect the Provider's technical data, product plans, and testing results disclosed through the platform as confidential information.
Users represent and warrant that:
They have the right to lend their Artifacts to the Provider and that their use by the Provider does not infringe on any third-party rights.
Artifacts contain no false/misleading statements, unlawful material, obscene/defamatory content, or impersonation of entities.
Artifacts comply with all applicable publicity/privacy laws.
Artist Account Fee: The fee for the Artist Account is €8 per month or €80 per year.
Payment Processing: Transactions are processed via Paddle.com, acting as the Merchant of Record and Users must review Paddle’s terms for business or private customers.
Renewal: Subscriptions will automatically renew at the end of the billing cycle unless cancelled.
Cancellation: Users can cancel their subscription or trial at any time, but they are responsible for doing so before their next renewal payment to prevent automatic renewal. Canceled subscriptions end with the currently paid subscription interval.
If you're a regular consumer (not a business), you can cancel your purchase within 14 days without giving any reason.
The 14-day period starts the day after your purchase is completed. To cancel on time, just send us your cancellation notice before the 14 days are up.
To cancel, tell the SystemKunst KG that you want to cancel. For fastest service, contact us here. Note that for subscription services, you can only cancel the initial subscription, not each automatic renewal.
You can also use our cancellation form or any other clear way to tell us you're canceling. If you use our online Contact Us form, we'll confirm we received your cancellation right away.
If you cancel as described above, we'll refund all your money.
We'll process your refund quickly, within 14 days of receiving your cancellation notice.
We'll use the same payment method you used originally, and you won't pay any fees for the refund.
You can't cancel if:
You've already started downloading, streaming, or using digital content
You've already started using the product
Refunds are provided at the sole discretion of the Provider and on a case-by-case basis and may be refused. The Provider will refuse a refund request if we find evidence of fraud, refund abuse, or other manipulative behaviour that entitles the Provider to counterclaim the refund.
This does not affect your rights as a Consumer in relation to Products which are not as described, faulty or not fit for purpose.
Users agree not to engage in inappropriate use of the Artificial Museum Framework, including but not limited to:
Reverse-engineer, scrape, or hack the Provider's systems, or attempt to download content using unauthorized tools (spiders, robots, crawlers, etc.).
Access services while operating vehicles or machinery.
Transmit unsolicited content or spam Users.
Upload unlawful, obscene, defamatory, libellous, threatening, harassing, hateful, or racially/ethnically offensive content.
Impersonate another person or entity.
Transfer, sublicense, lease, or rent the Artificial Framework to any third party.
This agreement may be terminated by either party if the other party breaches any material term or condition.
User Termination: The termination is valid within 30 days' notice, you can start the termination process by contacting us. Deleted accounts can not be recovered. In the case of deletion, paid subscriptions will not be refunded and can not be restored.
Provider Termination: Takes effect immediately for material breaches.

Service Disclaimer: The Provider's services are provided "as-is" and "as available."
Limitation of Liability: SystemKunst KG (part of the Provider) disclaims liability for service interruptions, data loss, third-party content errors, or any special, indirect, incidental, punitive, or consequential damages. SystemKunst KG will not be held accountable for any errors that occur when using the products and services.
Users assume all risks associated with their access to and use of the website and Artificial Museum, including, but not limited to, the risk of traffic accidents or injury if used while driving or operating machinery.
Users agree to defend and indemnify the Provider against claims arising from:
Intellectual property disputes over Artifacts.
Breaches of these terms or applicable laws.
Illegal or defamatory content in Artifacts.
This agreement shall be governed by and construed in accordance with the laws of Vienna / Austria. The Place of Jurisdiction is Austria.
This agreement constitutes the entire agreement between the parties and supersedes all prior agreements, whether written or oral.
This agreement may be amended by the Provider in the future.
Should any provision of this Agreement be deemed invalid, illegal, or unenforceable by any court of competent jurisdiction, such provision shall be deemed superseded by a valid, enforceable provision that, in the opinion of the parties, most closely matches the intent of the original provision. The remaining provisions of this Agreement shall remain in full force and effect.
